1. Acceptance of Terms

By accessing or using CheckReality.ai (the "Service"), operated by CheckReality, Inc. ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

CheckReality provides AI-generated and manipulated image detection through a web application and API. The Service analyzes uploaded images using multiple detection models and returns forensic reports with confidence scores.

3. Accounts

You must provide accurate, complete information when creating an account. You are responsible for maintaining the security of your account credentials and for all activity under your account. Notify us immediately of any unauthorized use.

4. Acceptable Use

You agree not to:

• Use the Service to violate any applicable law or regulation
• Upload content that infringes on third-party intellectual property rights
• Attempt to reverse-engineer, decompile, or extract our detection models
• Use the Service to facilitate fraud or deception
• Exceed your plan's rate limits or circumvent usage restrictions
• Resell or redistribute detection results without authorization
• Interfere with the Service's infrastructure or other users' access

5. API Usage

API access is subject to rate limits based on your subscription plan. We reserve the right to throttle or suspend API access for accounts that consistently exceed their limits or engage in abusive usage patterns.

6. Payment & Billing

Paid plans are billed monthly or annually as selected. Payments are processed by Stripe. All fees are non-refundable except where required by law. We may change pricing with 30 days' written notice. Free tier usage is subject to daily limits and may be modified at our discretion.

7. Intellectual Property

The Service, including all detection models, algorithms, software, and documentation, is the intellectual property of CheckReality, Inc. You retain all rights to images you upload. We claim no ownership of your content.

8. Detection Accuracy Disclaimer

Detection results are provided as analytical assessments, not definitive determinations. Confidence scores indicate statistical likelihood, not certainty. You should not rely solely on CheckReality results for critical decisions without independent verification. We do not guarantee 100% accuracy.

9. Limitation of Liability

To the maximum extent permitted by law, CheckReality, Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising from your use of the Service. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless CheckReality, Inc. and its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

11. Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms. You may cancel your account at any time. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination will survive.

12. Modifications

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or prominent notice on the Service. Continued use after changes take effect constitutes acceptance of the revised Terms.

13. Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles. Any disputes shall be resolved in the state or federal courts located in Delaware.
